Welcome to Soundheart Music! These Terms of Service ("Terms") govern your use of our website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms
By accessing or using Soundheart Music's Services, you agree to these Terms, including any additional terms and conditions referenced herein. If you do not agree to these Terms, please do not use our Services.

2. Use of Services
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years old.
You agree to use Soundheart Music's Services only for lawful purposes and in accordance with these Terms. You further agree not to use our Services in any way that violates any applicable laws or regulations.

3. Fetch Data Feature
Our Services include a fetch data feature that retrieves public information available on the internet. You understand and agree that this feature is designed to collect only publicly available information and does not access any private or restricted data.

4. Email Marketing
Soundheart Music's Services may include email marketing capabilities, allowing users to send emails to a list of contacts. You are solely responsible for ensuring that you have the necessary permissions to email the contacts provided through our Services.
You agree not to use our Services to send spam or unsolicited emails. Soundheart Music reserves the right to suspend or terminate your access to our Services if we believe you are in violation of this provision.

5. Intellectual Property
All content included in or made available through Soundheart Music's Services, including but not limited to text, graphics, logos, images, and software, is the property of Soundheart Music or its licensors and is protected by copyright and other intellectual property laws.
You may not use, reproduce, distribute, modify, or create derivative works of any content from our Services without the prior written consent of Soundheart Music.
You also may not share an account with anyone else, or share information you gained, unless you have EXPLICIT approval from a Soundheart Music Rep.

6. Disclaimer of Warranties
Soundheart Music's Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, error-free, or free from harmful components.

7. Limitation of Liability
In no event shall Soundheart Music be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, email address/es, data, or goodwill, arising out of or in connection with your use of our Services.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict of laws principles.

9. Changes to Terms
Soundheart Music reserves the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

11. Refund Policy

11.1 Refunds for Normal/Premium Plans:
Refunds for Normal/Premium Plans are available within a 35-day window from the date of purchase. To qualify for a refund, the following conditions must be met:

• The user must have actively utilized our software to compile a list of at least 240 contacts.

• The compiled contact list must be integrated into the email marketing automation system and a campaign must be actively running for a minimum of 30 days.

• The user must participate in a consultation call with a designated representative from Soundheart Music.

Refunds will be issued at the discretion of Soundheart Music following the completion of these requirements.

11.2 Refunds for Lite Plan:
Due to the nature of the Lite Plan service, refunds are not available. Upon cancellation of the Lite Plan, users will forfeit any unused credits as well as all information obtained through our software. Soundheart Music cannot retain data indefinitely and therefore cannot guarantee storage of user information beyond the active subscription period.

12.Lite Plan Clause
Users who subscribe to the Lite Plan, but don’t register an account, will be auto-issued one with the corresponding credits
